Clearouts – Terms and Conditions

These Terms and Conditions apply to all services provided by Clearouts (“we”, “us”, “our”) to the customer (“you”, “your”). By booking or using our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

1. Services

Clearouts provides rubbish removal, junk removal, green waste removal, bin cleanouts, property clearances, and related services.

We reserve the right to refuse any job or remove any items at our discretion, particularly where safety, legal, or environmental risks are present.

 

2. Quotes and Pricing

All quotes are based on the information provided at the time and may be adjusted if the actual volume, weight, type of waste, or site conditions differ from what was described.

Quotes are valid for 14 days unless otherwise stated.

Additional charges may apply for heavy items, hazardous materials, difficult access, excessive labour time, or disposal fees.

Final pricing will be confirmed on-site before work begins where possible.

 

3. Bookings and Access

You agree to provide safe, clear, and reasonable access to the property and all items to be removed.

If access is restricted, unsafe, or delayed, additional charges may apply.

You are responsible for ensuring you have permission for us to enter the property and remove items.

 

4. Payment Terms

An invoice will be issued upon completion of the job.

Payment is required within 7 days of the invoice date unless otherwise agreed in writing.

Payment can be made via bank transfer or other agreed methods.

Late payments may incur a 10% late fee if not paid within 7 days after the due date. Additional administrative fees and debt collection costs may also apply where necessary.

We reserve the right to refuse future services until all outstanding balances are paid in full.

Ownership of removed items transfers to Clearouts only once full payment has been received.

 

5. Cancellations and Rescheduling

Cancellations must be made at least 24 hours prior to the scheduled booking.

Late cancellations may incur a call-out fee.

We reserve the right to reschedule or cancel bookings due to weather, safety concerns, vehicle issues, staff availability, or other unforeseen circumstances.

 

6. Prohibited and Hazardous Waste

We do not accept hazardous or prohibited materials, including but not limited to:

• Chemicals, solvents, or hazardous liquids

• Asbestos

• Medical or biological waste

• Explosives or flammable materials

• Any illegal materials

If hazardous or prohibited waste is discovered, additional fees may apply and we reserve the right to refuse removal or terminate the job.

 

7. Customer Responsibilities

You agree that:

• All items presented for removal are safe to handle

• You have the legal right to dispose of all items

• All valuable or important items have been removed prior to our arrival

• Clearouts is not responsible for items mistakenly included in removal areas

 

8. Liability, Insurance and Property Damage

We take all reasonable care when carrying out our services.

Clearouts is not liable for:

• Pre-existing damage to property or structures

• Damage caused by weak, unstable, or deteriorated surfaces, driveways, paths, fences, or access points

• Hidden or non-visible damage that could not reasonably be identified prior to or during service

• Minor cosmetic damage that may occur as a result of normal and reasonable removal operations

To the maximum extent permitted by New Zealand law, our liability is limited to the total amount paid for the specific service provided.

Insurance

Clearouts holds Public Liability Insurance and Statutory Liability Insurance appropriate to our operations.

These insurances apply in accordance with their policy terms and do not extend to:

• Pre-existing property conditions

• Customer negligence or failure to provide accurate information

• Items or risks outside the agreed scope of work

 

9. Health and Safety

We reserve the right to refuse, pause, or stop work if conditions are unsafe.

This includes unsafe structures, aggressive behaviour, animals posing risk, hazardous environments, or any situation that may endanger staff or the public.

 

10. Ownership of Removed Items

Once items have been loaded and removed from the property, ownership transfers to Clearouts.

Items may be disposed of, recycled, or donated at our discretion.

 

11. Delays Beyond Our Control

We are not responsible for delays caused by events outside our control, including weather, traffic, accidents, mechanical breakdowns, or emergencies.

 

12. Privacy

Any personal information collected is used solely for service delivery, communication, invoicing, and business operations.

We do not sell or share your information except where required by law.

 

13. Disputes

If you are unhappy with our service, you must notify us within 48 hours of completion.

We will make reasonable efforts to resolve any issues promptly and fairly.

 

14. Compliance with Tauranga and Bay of Plenty Regulations

Clearouts operates in accordance with Tauranga City Council bylaws, Bay of Plenty Regional Council environmental regulations, the Waste Minimisation Act 2008, and all applicable New Zealand laws.

All waste is disposed of responsibly at approved transfer stations, recycling centres, or authorised facilities.

We do not engage in illegal dumping and strictly comply with all environmental and waste disposal regulations.

Customers must not request disposal of prohibited or unlawful waste.

 

15. Governing Law

These Terms and Conditions are governed by the laws of New Zealand and applicable local council bylaws.

 

16. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time. The most recent version will apply to all bookings.
